General terms and conditions (AGB) for orders from private persons in our online shop

1. Conclusion of the contract

With your order you make a binding offer to us to conclude a contract with you. We can accept this offer by sending you an order confirmation by e-mail or by delivering the ordered goods. First you will receive a confirmation of the receipt of your order by e-mail to the e-mail address you provided (order confirmation). However, a sales contract is only concluded when our order confirmation is sent to you by e-mail or when the ordered goods are delivered. When ordering via our online shop, the ordering process comprises a total of four steps. In the first step you select the desired goods. In the second step you enter your customer data including billing address and, if necessary, a different delivery address. In the third step you choose how you would like to pay. In the last step you have the possibility to check all details (e.g. name, address, method of payment, ordered items) once again and to correct them if necessary before you send us your order by clicking on 'Order with costs'.

2. Storage of the contract text 

We save the contract text of your order. You can print it out before sending your order to us by clicking on "Print" in the last step of the order. We will also send you an order confirmation as well as an order confirmation with all order data and our general terms and conditions to the e-mail address you have provided.

3. Reservation of proprietary rights

The delivered goods remain our property until all claims have been paid in full. 4. prices, shipping costs, return costs in case of revocation All prices are final prices, they contain the legal value added tax. There is no minimum order value. Shipping costs are calculated with a flat rate of 5,95 € (within Germany, to one address, no islands). The shipping costs for internal customers are valid up to an order value of 20,00 €. After that your order is free of shipping costs. This covers all costs for packaging, shipping documents and the usual transport and delivery costs for normal shipping. Should or must the delivery be made by express, courier or comparable services in order to meet the agreed delivery date, the costs incurred for this shall be borne by the customer. Please note that subsequent deliveries abroad are not free of charge. You will bear the direct costs of returning the goods.

4. Revocation

You have the right to revoke this contract within fourteen days without giving reasons. The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took or has taken possession of the last goods. In order to exercise your right of withdrawal, you must give us:

inform us by means of a clear statement (e.g. a letter, fax or e-mail sent by post) of your decision to withdraw from this contract. If you make use of this option, we will immediately (e.g. by e-mail) send you confirmation of receipt of such a revocation. In order to comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the end of the revocation period.

5. Consequences of revocation

If you revoke this Agreement, we shall reimburse you for all payments we have received from you, including delivery charges (except for additional charges resulting from your choosing a different method of delivery from the cheapest standard delivery offered by us), immediately and no later than fourteen days from the date we receive notification of your revocation of this Agreement. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this refund. We may refuse to make a refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier. You must return the goods without delay and in any event no later than fourteen days from the date on which you notify us of the cancellation of this agreement:

to be returned or handed over. The time limit shall be deemed to have been observed if you send the goods before the end of the fourteen-day period. You bear the direct costs of returning the goods. You will only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods that is not necessary for testing their condition, properties and functionality.

6. Terms of delivery

Delivery times are the delivery times stated in the offer, these start with receipt of payment. In the case of delivery on account or payment by direct debit, the delivery times begin with the acceptance of the contract by the company.

7. Terms of payment

The payment can be made either in advance by bank transfer or by Paypal. We reserve the right to exclude individual payment methods. If you choose the payment method prepayment, we will give you the bank details in the order confirmation. The invoice amount is to be transferred to our account within 10 days.

8. Warranty

The warranty is based on the legal regulations. If used goods are subject of the sales contract and the buyer is not a consumer, the warranty is excluded. If the customer is a consumer, the warranty period for the purchase of used goods is one year.

9. Data protection

During the initiation, conclusion, handling and reversal of a sales contract, data is collected, stored and processed by us within the framework of the legal provisions. When you visit our website, the IP address currently used by your PC, the date and time, the browser type and operating system of your PC and the pages you view are logged. Conclusions about personal data are not possible for us and are not intended. The personal data that you provide us with, for example, when placing an order or by e-mail (e.g. your name and contact details), will only be processed for correspondence with you and only for the purpose for which you have provided us with the data. We will only pass on your data to the shipping company commissioned with the delivery, as far as this is necessary to deliver the goods. For the processing of payments, we pass on your payment data to the credit institute commissioned with the payment. We assure you that we will not pass on your personal data to third parties unless we are legally obliged to do so or you have given your express prior consent. Insofar as we use the services of third parties for the execution and handling of processing procedures, the provisions of the Federal Data Protection Act are observed. Duration of storage Personal data that has been communicated to us via our website is only stored until the purpose for which it was entrusted to us has been fulfilled. Insofar as commercial and tax law retention periods must be observed, the duration of storage of certain data can be up to 10 years. Your rights If you no longer agree to the storage of your personal data or if the data has become incorrect, we will arrange for the deletion, correction or blocking of your data in accordance with the statutory provisions upon receiving a corresponding instruction. Upon request, you will receive information free of charge about all personal data that we have stored about you. 10. Applicable law

German law applies exclusively. In relation to a consumer, this choice of law shall only apply insofar as it does not restrict any mandatory legal provisions of the state in which the consumer has his residence or habitual abode.

11. Severability Clause

Should individual provisions of these terms and conditions be or become invalid in whole or in part, or should they contain a loophole, the validity of the remaining provisions or parts of such provisions shall remain unaffected. The invalid or missing provisions shall be replaced by the respective legal regulations.

12. Dispute settlement

The European Commission provides an Online Dispute Resolution (OS) platform, which you can find here http://ec.europa.eu/consumers/odr/. Consumers have the possibility to use this platform for the settlement of their disputes.
